Terms and Conditions
Governing mobile application engineering, cloud infrastructure deployment, and client collaboration with Rabishtra (operating at rabishtra.in).
Summary of Core Principles: When you work with Rabishtra, you retain 100% ownership of your source code and intellectual property upon milestone completion. We practice clear milestone deliverables, mutual confidentiality (NDA), and zero hidden agency overhead.
1. Scope & International Applicability
These Terms and Conditions ("Agreement") constitute a legally binding agreement between you or your corporate entity ("Client", "You") and Rabishtra ("Studio", "We", "Us", "Our"), providing native Android application development, cloud backend architecture (Firebase, AWS, Cloudflare, Supabase), API integrations, and technical consulting globally across jurisdictions including North America, Europe, the United Kingdom, India, and the Asia-Pacific region.
By commissioning project work, signing a statement of work (SOW), executing an estimate, or remitting project payments, you confirm full acceptance of these terms.
2. Technical Stack & Deliverables
Rabishtra provides end-to-end engineering tailored to the Client's written technical specifications:
- Native Android Applications: Developed within official Android Studio environments using Kotlin, legacy Java, modern Jetpack Compose, and traditional Android XML layouts, adhering to Google's official Architecture Guidelines and Material Design 3 specifications.
- Backend & Cloud Integrations: Infrastructure setup and client-side integration with Firebase (Authentication, Firestore, Cloud Functions, FCM, Crashlytics), Amazon Web Services (AWS), Cloudflare (Workers, DNS, CDN), and Supabase (PostgreSQL, Realtime, Edge Functions).
- Delivery Formats: Production release Android App Bundles (
.aab), testing APKs (.apk), and full Git repository commits containing documented source code and Gradle build scripts.
3. Intellectual Property & Code Ownership
We believe in complete freedom for our clients:
- Full Transfer of IP: Upon receipt of full and final payment for any agreed project or sprint milestone, all right, title, and interest in and to the custom source code, assets, UI layouts, and logic authored specifically for the Client shall transfer wholly and exclusively to the Client.
- Third-Party & Open Source Libraries: Standard open-source libraries (e.g., Apache 2.0, MIT-licensed Jetpack libraries, Retrofit, Coroutines) remain governed by their respective open-source licenses. We will never incorporate restrictive copyleft licenses (e.g., GPL v3) without the Client's explicit prior authorization.
- Portfolio Showcase Rights: Unless the Client requests a strict white-label NDA agreement prior to commencement, Rabishtra reserves the right to showcase the completed application mockup, screenshots, and an overview of architectural achievements in its public portfolio at rabishtra.in.
4. Confidentiality & Non-Disclosure (NDA)
Both parties agree to treat all business information, product concepts, source code, financial terms, credentials, and customer data as strictly confidential. Rabishtra will never share, sell, or disclose Client trade secrets or technical designs to third parties. We willingly sign and abide by standard bilateral Non-Disclosure Agreements (NDAs) prior to project discovery.
5. Milestones, Payments & Currencies
Rabishtra works on a milestone-based agile engagement model:
- Payment Schedules: Projects are structured into transparent milestones (e.g., 30% upfront kickoff deposit, 40% functional mid-sprint build, 30% final sign-off and Play Store release).
- Accepted Global Currencies: Invoices may be issued and settled in US Dollars (USD), Euros (EUR), British Pounds (GBP), or Indian Rupees (INR) via international wire transfer, Stripe, or verified escrow platforms.
- Refund Policy: Deposit fees are non-refundable once architectural research or coding sprints have commenced. In the event of project cancellation by the Client, payment is due for all milestone hours completed up to the date of written cancellation.
6. Google Play Store Submission & Compliance
Rabishtra assists in packaging and publishing client applications to the Google Play Console:
- Client Developer Account: Applications must be published under the Client's official Google Play Developer Account. The Client is solely responsible for Google's one-time developer registration fees and ongoing account compliance.
- Google Policy Adherence: We build applications strictly to pass Google Play Store Core App Quality guidelines and current target SDK standards. However, Google retains sole discretion over app approvals, rejections, or policy updates regarding specific industries (e.g., gambling, fintech, regulated medical devices).
7. Cloud Accounts & Recurring Costs
The Client retains direct ownership of all third-party cloud infrastructure accounts (Firebase, AWS, Cloudflare, Supabase, Google Cloud, Meta/WhatsApp Business API). All monthly recurring subscription costs, server compute expenses, and usage-based API fees are paid directly by the Client to the respective cloud service providers.
8. 60-Day Post-Launch Warranty & Maintenance
Every full production application shipped by Rabishtra includes a 60-day post-launch warranty period commencing on final sign-off. During this period:
- Any reproducible software bugs, ANRs, or crashes stemming from our original code will be diagnosed and fixed at zero additional cost.
- New feature requests, scope changes, or third-party API breaking changes introduced after launch are billed under separate maintenance agreements or hourly retainers.
9. Limitation of Liability
In no event shall Rabishtra be liable for any indirect, incidental, punitive, or consequential damages (including loss of profits, data corruption, or business interruption) arising out of the use or inability to use the application. Our total aggregate liability under any circumstances shall not exceed the total fees paid by the Client to Rabishtra under the specific Statement of Work in dispute.
10. Governing Law & Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any dispute arising under or in connection with this Agreement shall first be resolved through good-faith mutual consultation. If unresolved within thirty (30) days, disputes may be submitted to binding international commercial arbitration under standard UNCITRAL rules.
